Obtaining a Nevada resale certificate: Frequently asked questions

To operate a business legally in Nevada, retailers, wholesalers, and manufacturers are required to obtain sales and use tax permits or identification numbers. Furthermore, if your business purchases goods with the intent to resell them, you must obtain a Nevada resale certificate.

What is a Nevada resale certificate used for?

A Nevada resale certificate is a signed document that permits retailers and wholesalers to purchase items for resale without paying sales tax. It also allows manufacturers to purchase raw ingredients or elements used to create a new product for sale without being subject to sales tax.

However, if that component or item is used for your own use and not resold, you do have to pay sales tax on it.

Can I use an out-of-state resale certificate in Nevada?

Resale certificates are not typically transferable across state lines. But, there are exceptions.

Nevada does accept an out-of-state resale certificate if it contains a description of the type of property purchased for resale and the buyer’s and seller’s names. If the certificate is provided electronically, it does not require a signature.

How do I get a Nevada resale certificate?

To hold a valid Nevada resale certificate, you must first obtain a seller’s permit. If you offer any kind of product or service in Nevada, this is a basic requirement. It’s also known as a sales tax permit, sales tax license, sales and use tax number, or sales tax registration.

Next, download a resale certificate form from the Nevada Department of Taxation. To apply for a certificate, you will need to provide the following:

  • A valid seller’s permit number
  • A description of what you are in the business of selling
  • The name of the business
  • A description of the property to be purchased

How do I get a seller’s permit in Nevada?

Every new business must check with the State Department of Taxation to determine whether they need a resale permit, an exemption certificate, or are subject to use tax. A deposit or bond may be required.

A seller’s permit can be obtained by registering through SilverFlume (State of Nevada Business Portal) or by mailing in Nevada a Business Registration Form.

How much does a reseller permit in Nevada cost?

A Nevada reseller certificate is provided at no cost. However, the state does charge a fee for its prerequisite, the seller’s permit ($15 for each in-state location). If your business doesn’t have a physical location in Nevada, you must still pay the $15 fee.

How long does it take to get a Nevada’s sellers permit?

You can expect a two to three day turn around when applying online or up to two weeks when applying by mail to receive a seller’s permit.
