Historically, fair lending programs have relied on detection to identify disparities in outcomes across protected groups. For many institutions, these capabilities are already well established through data-driven analysis and routine monitoring.
While it remains a critical foundation, it’s no longer sufficient on its own to meet growing expectations.
In the recent webinar, Why detection isn’t enough: The case for Fairness Optimization, Wolters Kluwer and FairPlay A I discussed how the role of detection is evolving. The session featured Jason Keller, Director for Market Strategy – Compliance Analytics for Wolters Kluwer, and Kareem Saleh, founder and CEO of FairPlay AI.
A combination of regulatory demand, increasing model complexity, and broader adoption of AI is pushing institutions to move beyond simply identifying disparities toward understanding why they occur and how decisions can be improved.
Speaking about regulatory pressure, Keller said, “ What is the reality right now that we're facing from a fair lending perspective? We know we're in a shifting regulatory environment, but detection alone is not just [going to] satisfy regulators.”
Here are five reasons traditional detection approaches are falling short.
1. Detection identifies disparities, but not the reasons behind them
Self-check: Can you explain both where disparities exist and why they occur?
Detection tools are effective at identifying differences in outcomes. Most institutions today are well equipped to understand what’s happening within their portfolios.
The harder question is why it’s happening.
Traditional detection approaches:
- Surface disparities across groups
- Require additional manual work to investigate root causes
- Do not inherently isolate which variables or interactions are driving outcomes
- Do not assess whether alternative approaches could reduce disparities
That creates a limitation for decision-making. Without a clearer understanding of causality or potential alternatives, institutions are limited in how effectively they can respond.
2. Regulatory expectations now go beyond measurement
Self-check: Can you demonstrate how alternative approaches were evaluated?
Regulatory expectations continue to shift, even in an established environment.
Several points remain consistent:
- Examinations continue to be data-driven
- There’s greater scrutiny on why disparities occur
- Institutions are expected to provide evidence that alternatives were evaluated
- A lack of awareness is not considered an adequate explanation
Detection alone is no longer enough to satisfy expectations. Institutions are expected to demonstrate a clear, documented effort to explore less discriminatory alternatives (LDAs).
3. Fair lending risk now extends across the customer lifecycle
Self-check: Are you primarily monitoring fair lending risk in underwriting?
Fair lending risk is no longer confined to underwriting or pricing decisions. It can emerge across multiple stages of the customer journey, including:
- Marketing
- Fraud detection
- Identity and income verification
- Account management
- Servicing
- Collections
Fair lending obligations apply to any decision connected to a credit transaction, and AI is increasingly embedded across these processes. That expansion increases the number of systems requiring oversight. Focusing on a single stage no longer provides a complete view of fair lending risk.
4. AI is heightening decision complexity and oversight challenges
Self-check: Can your current oversight processes still interpret progressively complex models?
The growing use of AI and machine learning is making decision systems more variable-rich and harder to interpret, while manual testing approaches are difficult to scale.
At the same time, expectations around transparency and governance remain unchanged. Institutions are still expected to understand how decisions are made and how variables impact different populations.
This creates a clear hurdle: Decisioning is becoming more complex, while expectations for explainability are not diminishing.
5. Detection is retrospective and limited in driving improvement
Self-check: Are you only reviewing past outcomes, or actively testing alternative decision strategies?
Detection-based approaches are naturally backward-looking. They focus on outcomes after decisions have already been made.
That creates several limitations:
- Issues are identified after the fact
- There is no structured way to test alternative strategies in advance
- Detection alone does not support proactive improvement
While disparities can be identified, detection does not help determine whether different decision strategies could achieve similar outcomes with reduced disparity.
That gap becomes more important as institutions look to improve both fairness and performance. Without the ability to test alternatives, there is often a disconnect between insight and action.
Conclusion
Detection remains essential, but it is no longer enough on its own.
Fair lending programs are evolving toward approaches that can:
- Evaluate the drivers behind disparities
- Test alternative decision strategies
- Provide evidence of those evaluations
- Support governance across complex, AI-driven systems
For financial institutions, the implication is practical. Meeting expectations now requires moving beyond identifying issues toward actively exploring how decisions can be improved while maintaining risk tolerance and operational effectiveness.
“You've got this potential for fair lending risk that arises from the data, from the models themselves, from changes in the macro environment,” Saleh said. “And you need tooling to be able to address, identify, and fix those fair lending risks at every step of the model development cycle.”
Detection will continue to play a central role. But in an environment defined by growing complexity and scrutiny, it is increasingly just the starting point.
