FAQs: Permissions, Reprints, and Licensing Services

Frequently asked questions on Wolters Kluwer Legal & Regulatory U.S. permissions, reprints, and licensing services.

    • How do I determine if the material I wish to use is copyrighted?
Works published after 1922 are copyrighted (including journals and newsletters). Works created after 1978 remain copyrighted for the life of the author plus 75 years. Works created and published before 1978 remain copyrighted for 75 years from the publication date if copyright was renewed. Works created by an individual while employed by the federal government are in the public domain. Works published before 1922 are in the public domain.
    • Do I need permission from the authors as well as from the publisher?
In most instances, concurrent permission is not required. If an author has requested he/she grant permission as well, we will indicate this on our permissions response. A few authors have retained their rights to the material. You will receive a denial letter indicating permission must come directly from the author.
    • The material I wish to use has a notice indicating that it was Reprinted from, Adapted from, Data from, or Courtesy of. Do I still need to request permission from Wolters Kluwer Legal & Regulatory U.S.?
Although Wolters Kluwer Legal & Regulatory U.S. publications contain a copyright notice in the front of the publication (ex. © 2017 CCH Incorporated, © 2017 Kluwer Law International), this does not mean we own the rights to all the material contained within the publication. Wolters Kluwer Legal & Regulatory U.S. cannot grant permission for any material with a credit line indicating the material was 'reprinted from,' 'adapted from,' or 'courtesy of'. You will need to contact the original source listed in the credit line. Wolters Kluwer Legal & Regulatory U.S. can grant permission for material containing a 'data from' source line. This indicates the author(s) used information from another source to create his/her own artwork. If the material you wish to use does not contain a source line, Wolters Kluwer Legal & Regulatory U.S. owns the material and can grant permission.
    • Do I need to request permission if I am using a small portion of Wolters Kluwer Legal & Regulatory U.S. material or paraphrasing Wolters Kluwer Legal & Regulatory U.S. material?
Under the 'fair use' clause, you are free to use material for criticism, comment, news reporting, teaching, research, or parody. However, there are four factors involved in determining 'fair use': • The intended use of the material and whether the use is for commercial or nonprofit purposes; • The nature of the copyrighted material; • The amount of material used in relation to the entire work; • The effect of the use on the potential market of the material. Permission is not needed for quotes or paraphrasing if the above criteria is met; however, all borrowed material must still be sourced to Wolters Kluwer Legal & Regulatory U.S.. When in doubt, you should always seek permission.
    • Do I need to request permission if I do not reprint Wolters Kluwer Legal & Regulatory U.S. material exactly as it originally appeared?
Yes, in this instance your use would be considered an adaptation and Wolters Kluwer Legal & Regulatory U.S. would still own the rights to the material.
    • How can I request permission to use Wolters Kluwer Legal & Regulatory U.S. content?

Please contact the Copyright Clearance Center for all of the following request types.

      • Photocopy requests (including coursepacks)
      • Email requests (up to 250 recipients)

    • What if I can’t find a Wolters Kluwer Legal & Regulatory U.S. publication on the Copyright Clearance Center website?

    • If the copyright notice is in the author's name, do I still need to request permission from Wolters Kluwer Legal & Regulatory U.S.?
Yes, in some cases the author has retained the rights to the publication while giving Wolters Kluwer Legal & Regulatory U.S. the right to grant permission to use the material. If the author has retained both rights, you will receive a letter of denial indicating that you must go directly to the author for permission.
    • If the material is out-of-print do I still need to request permission?
Unless the material was published before 1922, the material is still copyrighted. When Wolters Kluwer Legal & Regulatory U.S. declares a book out-of-print, the rights may automatically revert back to the author(s)/editor(s). Please contact Wolters Kluwer Legal & Regulatory U.S. with your request and we will let you know the current rights status of the publication. The best way to contact us with your permissions request is to select the appropriate “Permissions Request Form” from our Licensing & Permissions Home Page.
    • If the material is out-of-print and the author/editor is deceased, do I still need to request permission?
Yes. If the author/editor is deceased, the rights have reverted to the author's estate or to someone designated by the author.
    • Do I need to request permission each time I wish to use the material?
Yes, Wolters Kluwer Legal & Regulatory U.S. grants permission for one-time use only. Permission must be requested each time you use the material.
    • Does Wolters Kluwer Legal & Regulatory U.S. accept requests for electronic texts for people with disabilities?

For all other electronic uses, the best way to contact us is to select the appropriate “Permissions Request Form” from our Licensing & Permissions Home Page.
    • What is the difference between reprinting/republishing, photocopying, and reprints?
